The right of the citizens to keep and bear arms has justly been considered, as the palladium of the liberties of the republic; since it offers a strong moral check against the usurpation and arbitrary power of rulers; and will generally ... enable the people to resist and triumph over them." Last week, Angel Shamaya, founder and former Director of Keep and Bear Arms was arrested; he is out on bail. Angel was charged with four misdemeanor counts of possessing firearms not properly registered in the State of Michigan. While Angel is out on bail, I say enough is enough. Angel was not in violation of the law, the State of Michigan is by not being in compliance with the Second Amendment. Angel is required under the Second Amendment to own and possess fire arms as so succinctly explained by Dr. Edwin Vieira in his columns. How many more of our fellow Americans will we allow to be rounded up and jailed for being in compliance with the written law of the land?
For those who have missed the brilliant constitutional analysis on the Second Amendment by Dr. Edwin Vieira, here are a few critical points: Second Amendment as ratified: A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed.
"By definition, "the security of a free State" is "homeland security" (the "homeland" being, not simply a geographical area, but a special political conception rooted in freedom). The Amendment describes "[a] well regulated Militia" as "necessary" (not simply useful) for such "security". And the Amendment singles out "the right of the people to keep and bear Arms" as so important to the existence of such a "Militia" that "the right * * * shall not be infringed". Therefore, the fundamental constitutional institution of "homeland security" must be "[a] well regulated Militia" based upon "the right of the people to keep and bear Arms".
"Because the Constitution itself empowers "the Militia of the several States" for National purposes, the Militia are not optional, discretionary, or disposable for Congress, the President, the Judiciary, the States, or even We the People. First, because the Militia are "the Militia of the several States", Congress lacks all authority either to create or to dissolve them. Congress also lacks authority to disregard, neglect, or impede the Militia, with respect either to their performance of their constitutionally mandated services to the Nation, or to their practical ability to perform those services.
"Second, although "the Militia of the several States" are State institutions, the States cannot dispense with them, either, because the Constitution presupposes their permanence, and the Constitution is "the supreme Law of the Land". (End of excerpt)
In a nutshell: The militia as mandated by the Second Amendment cannot be eliminated, ignored, disregarded or blocked in any way by the federal or state governments. The militia as mandated by the Second Amendment requires the people own and bear arms in order to to maintain the security of the several states of the Union. Edwin further explains the law:
"Concomitant with this right and power, furthermore, is the personal constitutional duty of every American to serve in the Militia in some capacity, unless excused by immaturity, senility, physical disability, or other proper legal exemption or disqualification. If Congress and the States fail or refuse to exercise their powers and to fulfill their duties with respect to the Militia, each and every American must fill the gap by exercising his own duties within the boundaries of the law. "
Angel is not in violation of the supreme law of the land whether his weapons were concealed or sitting right out in plain sight. Angel is compliant with the law and ready to be "called up" as Edwin again explains in plain English:
"Fourth, because (as Part Two of this article will explain) the Militia are composed of We the People in arms, all Americans retain the right and reserve the power to array themselves in "the Militia of the[ir] several States" should Congress and the States completely fail, neglect, or refuse to perform their duties in that particular. This right and power derives from:
"- We the People's explicit adoption, incorporation, and empowerment of the Militia in the Constitution, which cannot be defeated by inaction, incompetence, negligence, or criminality on the part of their mere agents;
"- the mandate of the Second Amendment, which recognizes (i) "[a] well regulated Militia" as "necessary to the security of a free State", (ii) "the right of the people to keep and bear arms" as the precondition for such a Militia, beyond the power of public officials to "infringe[ ]", and therefore (iii) the right of the people to form themselves into constitutional Militia when "the security of a free State" is at risk; and, in the final analysis,
" - in the case of a criminal conspiracy among public officials to deprive Americans of their lives, liberties, or property, the overarching principle of the Declaration of Independence, that "when a long train of abuses and usurpations, pursuing invariably the same Object evinces a design to reduce the[ people] under absolute Despotism, it is their right, it is their duty, to throw off such Government, and to provide new Guards for their future security". We are all aware that keeping with the agenda of world government and the total destruction of our sovereignty and God given rights, Congress, backed up by Clinton and Bush, have steadfastly refused to protect the States of the Union from invasion by hordes of illegals. On March 8, 2006, Arizona Governor Janet Napolitano called up more of the National Guard in an attempt to stave off the massive invasion of illegals crossing into her state. If the State of Arizona were complaint with the Second Amendment, Napolitano would have been able to activate the organized militia of her state to repel this invasion since the feds refuse to do anything other than offer up more rhetoric and Band Aids.
The Dubai port sell out has dominated the media the past few days with back room double dealing going on which will still allow foreign governments with terrorist ties to set up shop right on our own soil. This sickens me beyond words. On March 10, 2006, Chuck Baldwin reported in his column that our our military bases will soon fall further under control of foreign governments. How well I remember when the communist Chinese, our mortal enemies, were given a free pass to our shores with the Long Beach/Costco deal, kissed and blessed by Marxist Bill Clinton. While hundreds of thousands of us yelled down the roof, the cowardly "conservative" GOP controlled Congress allowed it to go through anyway. Now, they suddenly have a problem with this new round of selling off American soil and security? What phoney's. What hypocrisy.
There can be no more confusion or misunderstanding about the agenda coming out of Washington, DC. These scoundrels are no longer making any pretense of adhering to the supreme law of the land nor do they care what we the people want. Anyone not in a state of denial and who has done the hard research recognizes that it doesn't make any difference which party is in control, the ultimate goal is the annihilation of this republic. The only thing standing between that outcome and saving our country and our children's future is us and the clock is ticking.
The Second Amendment is the law of the land. There has been no constitutional amendment to abolish, alter or change it in any way. Gun organizations like the NRA have been "lobbying" Congress for forty years to stop the gun grab by prissy men in public office and organizations like Gun Control, Inc. It doesn't matter if anti-gun legislators like Don Perata (California state senator) doesn't like the Second Amendment, it's the law. For Perata not to support the immediate reconstitution of the state militias is to admit his blatant disregard for the law. It doesn't matter if the lawbreakers in the Michigan State Legislature or the local sheriff who arrested Angel Shamaya don't want to recognize the Second Amendment, it is still the supreme law of the land.
Those who would say this is "extremist" or radical" are either ignorant of the history of this republic or too afraid they will be required to perform their constitutional duty in protecting their state and this country as part of their state militia. Cowards and lazy slugs who don't want to give up their leisure time for freedom. They would rather all the guns be in the hands of government and law enforcement to "keep them safe." Such thinking creates slaves.
The American people are so far out of touch with their responsibilities under the law in relation to homeland security, it's pathetic. Freedom isn't free, it's not a spectator sport and guns are the teeth of liberty. As Edwin so astutely points out: by reconstituting the state militias as mandated by law under the control of the state, Americans will be forced to be a participant in making sure America remains a free country, repelling this invasion by illegals and actually find out what it really means to stand up and be a real man. I've bad my belly full of sissy men who whine and do nothing but complain. Perfumed princes who continue to play stupid political games (the "left" v the "right") and drowning in beer, sports and porn, instead of acquiring a full and complete knowledge of their role as "homeland security" for their state and this republic.
