According to constitutional attorney, Larry Becraft:

"Earlier this year, a party in Tax Court made the argument that the current 6020 reg, 26 CFR 301.6020-1, had never been really adopted as a <>formal reg pursuant to the Administrative Procedure Act, 5 USC 552. Within a month of the making of that argument, IRS proposed a completely new regulation for 26 USC 6020. On July 18, notice of such was published in the Federal Register stating that comments to the reg can be made until Oct 17, 2005."

Here's a quick summary to the 6020 regulation issue:

1, The proposed regulation does not list or describe the "form prescribed" by the Secretary that is valid for or as a substitute [for] return. The legislative history of IRC sec. 6020 goes back to 1864 (see, sections 14 and 16 of the Act of June 30, 1864, ch. 173, 13 Stat. 226 and revised statute 3176) and requires that a substitute [for] return be made on the form or list prescribed by the Secretary.
2, The proposed regulation does not specify how the form is to be subscribed by one of the Secretary's delegates.
3, The proposed regulation introduces a new form that does not contain a jurat necessary to make it admissible as evidence under the Fed. Rules of Civil and Criminal Procedure.
